Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you", or "your") and Luminary Tours LLC ("Luminary Tours", "we", "our", or "us"), a limited liability company registered in the State of Wyoming, United States.

By accessing our website at luminarytours.com or any affiliated website operated by Luminary Tours LLC, or purchasing any of our services, you agree to be bound by these Terms. These Terms are effective as of the date of your first use of the website or first purchase of any service, whichever comes first.

Luminary Tours reserves the right to update or modify these Terms at any time. We will notify users of material changes by updating the effective date at the top of this page. Your continued use of our services after any changes constitutes acceptance of the updated Terms. If you do not agree to these Terms, please do not use our services.

2. Services Provided

Luminary Tours LLC provides the following custom, remote digital services:

  • Custom itinerary planning for travel in Japan and other destinations
  • Travel concierge services (reservations, bookings, and real-time travel support)
  • Client support throughout the planning and travel process
  • Local tour coordination in Japan, Morocco, and Egypt
  • Web development and digital marketing for businesses
  • Business consulting and sales management for the tourism and hospitality industry

All services are custom and tailored to the client's specific requirements. Service details, scope, and deliverables are agreed upon before work begins via written proposal or email confirmation. No service begins until the scope has been confirmed in writing.

Important: Luminary Tours LLC acts as a coordinator and service provider. We are NOT a licensed travel agency, airline, hotel, or transportation company. We coordinate services through third-party local operators and providers. The quality and delivery of third-party services are the responsibility of those providers. We take care in vetting our partners, but we cannot guarantee the performance of third parties beyond our reasonable control.

3. Pricing & Payment

  • Currency: All prices are quoted in United States Dollars (USD) unless otherwise specified in writing.
  • Payment processing: All payments are processed via Stripe (credit card and debit card). Luminary Tours LLC does not store your credit card number, CVV, or full payment card details on our servers. Stripe handles all payment data under PCI-DSS compliance.
  • Tour bookings — deposit: A deposit of 30% of the total tour price is required at the time of booking to secure your reservation. The remaining 70% balance is due no later than 14 days before the tour date.
  • Web development & consulting: Payment terms are specified in the project proposal. Typical terms are 50% upfront before work begins and 50% upon completion and delivery. Specific milestone payments may be agreed in writing for larger projects.
  • Taxes: All prices are exclusive of applicable taxes, VAT, or other levies unless expressly stated otherwise. You are responsible for any taxes applicable in your jurisdiction.

4. Cancellation & Refund Policy

Our full cancellation and refund policy is available on our dedicated Refund Policy page. Key points:

  • Cancellation terms vary by tour type (walking tours, driver tours, high season, luxury & multi-day packages).
  • Free cancellation windows range from 24 hours to 30 days depending on the service booked.
  • No-shows are non-refundable for all tour types.
  • Bookings including pre-purchased tickets or hotel reservations are subject to provider refund policies plus a 15% administrative fee (minimum $100).
  • EU consumers: tours are exempt from the 14-day cooling-off period under Article 16(l) of Directive 2011/83/EU.
  • All cancellation requests must be submitted in writing to info@luminarytours.com or the contact email listed on the website through which you booked your service.
  • Approved refunds are processed within 10 business days via the original payment method.

5. Booking Confirmation & Changes

A booking is confirmed only after Luminary Tours LLC sends a written confirmation via email. Verbal agreements, chat messages, or draft quotes do not constitute a confirmed booking.

  • Changes to confirmed bookings (dates, itinerary, group size, service scope) are subject to availability and may incur additional costs.
  • Luminary Tours will make reasonable efforts to accommodate changes but cannot guarantee availability, particularly during high season.
  • Requests to change tour bookings within 24 hours of the scheduled start time may be treated as cancellations under the applicable cancellation policy.

6. Client Responsibilities

By engaging our services, you agree to:

  • Provide accurate and complete information required for your booking or project, including names, travel dates, preferences, and any relevant passport or visa details.
  • Ensure that all members of your traveling party hold valid travel documents (passports, visas) required for entry to all destinations on your itinerary. Luminary Tours is not liable for denied entry resulting from inadequate travel documents.
  • Obtain appropriate travel insurance for international tours. We strongly recommend comprehensive coverage including medical emergencies, cancellations, and personal liability. Travel insurance is recommended but not required by us.
  • Follow all local laws, regulations, and customs in the countries you visit, and behave respectfully toward guides, local communities, and service providers.
  • Disclose any medical conditions, dietary requirements, or physical limitations relevant to your tour before the booking is confirmed.

7. Limitation of Liability

Luminary Tours LLC's total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim.

Luminary Tours is not liable for:

  • Delays, cancellations, or failures by third-party providers (airlines, hotels, transportation companies, local guides).
  • Personal injury, illness, or death during tours, except where directly and solely caused by our own negligence.
  • Loss, theft, or damage to personal belongings during a tour.
  • Acts of God, government actions, force majeure events, natural disasters, pandemics, or other circumstances beyond our reasonable control.
  • Indirect, incidental, special, consequential, or punitive damages of any kind, even if advised of the possibility of such damages.

8. Intellectual Property

Web development services: Upon receipt of full payment, the client owns the deliverables created specifically for them (website code, designs, and content). Luminary Tours retains the right to display the work in its portfolio and marketing materials unless the client requests otherwise in writing prior to project completion.

Itineraries and travel materials: Custom itineraries, guides, and travel materials created for clients are for their personal use only and may not be resold, redistributed, or published commercially without our prior written consent.

Luminary Tours brand: The Luminary Tours name, logo, and all brand materials remain the exclusive property of Luminary Tours LLC. All content on our website — including text, design elements, and graphics — is protected by applicable copyright and intellectual property law. You may not reproduce or distribute any content without prior written consent.

9. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms or our services shall first be attempted to be resolved through good-faith negotiation between the parties. Either party may initiate this process by providing written notice describing the dispute.

If negotiation fails to resolve the dispute within 30 days of the written notice, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall be conducted in English. The arbitrator's decision shall be final and binding.

The prevailing party in any dispute resolution proceeding is entitled to recover reasonable attorney fees and costs from the non-prevailing party. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
